Decade-old debate about detainees emerges again

Capt. Glenn Sulmasy op-ed on page E - 6 of the San Francisco Chronicle Sunday. Read below for an excerpt of the article:

The Senate Armed Services Committee on Monday was touting "new legislation" drafted in bipartisan fashion that responds to the question of what to do with the detainees in the war on al Qaeda. Committee leaders Sens. John McCain. R-Ariz., and Carl Levin, D-Mich., hailed the legislation as a "balanced approach." The Obama administration, however, is threatening to veto the proposal. Unfortunately, although meritorious in effort, it appears the legislation, passed Thursday by the full Senate on a 93-7 vote, will only cement existing ambiguity by providing the Obama administration (or others within the executive branch) the authority to determine whether the captured fighter should be tried in the military or civilian system.

Capt. Glenn Sulmasy is a judge advocate and an expert in national security law. He has been on the faculty of the U. S. Coast Guard Academy since July, 2001. He has also served on the faculty of the International Law Department at the U. S. Naval War College and has been an adjunct faculty member at the Roger Williams University School of Law since 1999. 

Sulmasy publishes and lectures widely on the law of armed conflict, international law and national security matters.
